The ASU has carefully considered the decision to approve the 2018 Agreement. We believe that the 2018 Agreement should not have been approved because:
- The Commission’s assessment that the 2018 Agreement passed the better off overall test was not correct;
- The undertakings accepted by the Commission have made substantial changes to the Agreement. This means they should not have been accepted; and
- The Commission denied us procedural fairness by making its decision based on information given to it by the Swissport that was not available to the ASU.
The ASU lodged its application for the appeal with the Fair Work Commission on 20 February 2020. Our appeal will be heard by a Full Bench of the Fair Work Commission.
