Casual social and community services workers win return of correct weekend overtime rates

After an appeal by the ASU to the Full Bench of the Fair Work Commission (FWC), casuals employed under the Social Community Home Care and Disability Services Industry Award 2010 will once again have access to appropriate rates for overtime worked during weekends.

This follows a decision in 2012 by the FWC's Vice President Watson that saw casual workers under the SCHCDS Award suffer income losses when they worked overtime on weekends, having access only to their basic casual loading rate.

The led to the anomalous situation where casual workers were being paid less than permanent part time and full time workers.

The Full Bench determination removes the irregularities around overtime from the Award that resulted from misapplication of precedents. You can read the amended clauses here:
